Terms of Service

1. Agreement

By accessing or using GetDocsSigned (“the Service”), operated by Bacano Systems LLC (“we,” “us,” or “our”), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

GetDocsSigned provides electronic signature, AI-powered form creation, document collection, and related services. We reserve the right to modify, suspend, or discontinue any part of the Service at any time with reasonable notice.

3. Accounts and Billing

You must provide accurate account information. Subscriptions are billed monthly or annually through Stripe. Your subscription includes a 7-day free trial; your card will not be charged until the trial ends. You may cancel at any time. Refunds are not provided for partial billing periods.

4. Acceptable Use

You agree not to use the Service to:

  • Send fraudulent, misleading, or illegal documents
  • Forge or misrepresent signatures
  • Violate any applicable law or regulation
  • Upload content that infringes third-party intellectual property rights
  • Attempt to gain unauthorized access to other accounts or our systems

5. Electronic Signatures

Electronic signatures facilitated through the Service are intended to comply with the Electronic Signatures in Global and National Commerce Act (ESIGN Act) and the Uniform Electronic Transactions Act (UETA). You are responsible for ensuring your use of electronic signatures complies with applicable law for your specific use case. We provide audit trails and signing records but do not provide legal advice.

6. Data and Privacy

Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

7. Intellectual Property

You retain ownership of all documents and content you upload. By using the Service, you grant Bacano Systems LLC a limited license to process, store, and transmit your content solely to provide the Service. We retain all rights to the Service itself, including our software, design, and trademarks.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BACANO SYSTEMS LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE THREE MONTHS PRECEDING THE CLAIM.

10. Termination

We may suspend or terminate your account for violation of these Terms. You may cancel your account at any time from your billing settings. Upon termination, your access to the Service will end and your data will be retained for 30 days before deletion, unless required by law to retain longer.

11. Governing Law

These Terms are governed by the laws of the State of Florida, USA, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Florida.

12. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes via email or in-app notice. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
